O Superior Tribunal de Justiça decidiu que um cidadão homossexual tem o direito de receber pensão do plano de previdência privada que era pago pelo companheiro que morreu. A relatora do processo, ministra Nancy Andrighi, afirmou que quando é comprovada a união afetiva entre pessoas do mesmo sexo, o direito tem de ser garantido exatamente como acontece nos casos de união estável entre homem e mulher.
A decisão do STJ é inédita. Até hoje, o direito de os homossexuais receberem pensão se limitava aos casos de previdência pública. O tribunal reconheceu que o casal conviveu durante 15 anos e determinou que a Previ (Caixa de Previdência dos Funcionários do Banco do Brasil) pague a pensão. A Previ se negava a pagar a pensão com a justificativa de que só haveria esse direito “a partir do momento em que a lei reconheça a união estável entre pessoas do mesmo sexo”.
Os ministros, contudo, cassaram a decisão do Tribunal de Justiça do Rio de Janeiro, que havia rejeitado o pedido de pensão. De acordo com o TJ fluminense, a Lei 8.971/94, que trata do direito de sucessão, não poderia se aplicar às relações entre parceiros do mesmo sexo. A ministra Nancy Andrighi, contudo, cassou a decisão.
Para Nancy, a união entre pessoas de mesmo sexo não pode ser ignorada já que as estruturas de convívio familiar estão cada vez mais complexas. A relatora ressaltou que o preconceito não pode servir como justificativa para que sejam suprimidos direitos fundamentais das pessoas. Os ministros acompanharam a decisão por unanimidade, com o argumento de que a união entre homossexuais, hoje, é vista como entidade familiar exatamente como as tradicionais.
Advogados que trabalham com direito de Família comemoraram a decisão. Para o advogado Felício Rosa Valarelli Junior, é preciso “levar em consideração a evolução da sociedade e o surgimento de novas entidades familiares, compostas por pessoas do mesmo sexo e filhos adotivos no seio da família”. Segundo o advogado, em outras decisões, o Judiciário já reconheceu o direito aos benefícios da previdência pública a pessoas do mesmo sexo. Por isso, não poderia agir diferente no caso de previdência privada.
